All Charges Dismissed In Burnett County Infant Death Case

BURNETT COUNTY -- All criminal charges have been dismissed against Jesse Marek of Grantsburg, WI, one of two people charged criminally in the death of an infant in Burnett County.

DrydenWire.com reported in April 2017, that Jesse Marek and Samantha Stoeklen, also of Grantsburg, WI, were facing criminal charges of child abuse causing harm regarding the death of their infant child in February 2016.

Online circuit court records show that the criminal charges against Stoeklen were dismissed in September of 2017.

According to the original criminal complaints filed against Marek and Stoeklen, an autopsy conducted on the deceased infant revealed that the infant had sustained numerous injuries including heart damage, internal bleeding, and injuries to his upper lip as well as multiple rib fractures that were all in various stages of healing.

Although a Jury Trial regarding Marek’s criminal charges was scheduled to begin on April 29, 2019, online circuit court records show that the charges against Marek were Dismissed on Defendant’s Motion.

Marek’s charges were dismissed without prejudice according to Stipulation and Order to Dismiss documents obtained by DrydenWire.com that were filed in Burnett County Circuit Court. A dismissal without prejudice means that the State could choose to re-file criminal charges, however, it is unknown at this time if any charges will be re-filed.

The Court Order to Dismiss orders the Medical Examiner’s Office to preserve the autopsy evidence until further order of the Court.
