A Polk County woman has been sentenced to prison for a conviction of 9th offense Operating While Intoxicated (OWI).
Mavis Rogers, of Luck, WI, was charged with 9th offense OWI in Burnett County Circuit Court in September 2016 after an incident in which the Village of Webster Police Department was dispatched to locate a vehicle reported to be swerving all over the road and then later reported to be stopped with an unconscious female in the vehicle.
According to the criminal complaint, police officers located the vehicle parked at Main Street and Highway 35. There was a man at the scene and the officer saw him remove keys from the vehicle and throw them on the ground. However, that man declined to provide any further information to the officer.
A Burnett County Sheriff's Office deputy assisted at the scene. A woman was sitting in the driver's seat of the vehicle and appeared to be trying to use a cell phone. The officer saw an open can of alcohol sitting in the center console and could smell the odor of alcohol coming from the vehicle.
The woman got out of the car and was identified as Mavis Rogers. The criminal complaint states that her speech was very slurred while she was talking with the officer. She said she was alone and that she had been driving and that she was trying to go Hayward. While the officer went to the squad car to get some paper, the woman got back in the vehicle and continued trying to use the cell phone. The criminal complaint continues stating that the officer noticed that the open can of alcohol in the center console had been moved.
Rogers agreed to do field sobriety testing and throughout the testing was continuously swaying and losing her balance. Rogers agreed to a preliminary breath test and according to the criminal complaint, the result of that test was 0.179. Five open cans of Michelob golden light were found inside the vehicle; one of the cans was half-empty.
The officer placed Rogers under arrest and transported her to the hospital where she agreed to give a sample of her blood.
Public record shows that an additional charge of 9th Offense Operating With a Prohibited Alcohol Concentration was filed against Rogers in October of 2016 in Burnett County Circuit Court. The criminal complaint indicates that Rogers had a blood alcohol level of 0.190.
The criminal complaint further details that Rogers was previously convicted of OWI on the following dates:
- July 14, 1993, in Barron County, WI in connection with an incident which occurred on June 19, 1993.
- May 31, 1995, in Polk County, WI in connection with an incident which occurred on October 10, 1994; November 15, 1995, in Polk County, WI in connection with an incident which occurred on May 26, 1995.
- April 17, 1996, in Barron County, WI in connection with an incident which occurred on March 11, 1996.
- October 4, 1999, in Barron county, WI in connection with an incident date of March 24, 1999.
- December 6, 1999, in Polk County, WI in connection with an incident which occurred on April 6, 1999. August 23, 2004, in Polk County, WI in connection with an incident date of June 17, 2003.
- September 21, 2009, in Barron County, WI in connection with an incident which occurred on May 20, 2009.
Rogers appeared in Burnett County Circuit Court on April 6, 2017, and the Court found her guilty of OWI 9th Offense. Public record shows that Rogers has been sentenced to 3 years confinement in state prison followed by 6 years of extended supervision by the Wisconsin DOC, Probation & Parole.
