Conviction for Threatening Law Enforcement Gets Man Additional Jail Time

Alan Fusak, of Prentice, WI, has been sentenced on his Washburn County charges and ordered to serve that sentence consecutive to his sentence for a Felony Armed Robbery Conviction in Ashland County Circuit Court.

On February 14, 2017, DrydenWire.com reported that Fusak was facing charges in multiple Wisconsin counties, including Washburn County. The criminal complaint filed against Fusak in Washburn County stated that he was arrested by Washburn County Deputies while they were following up on arrest warrants from other counties. During transport to the Washburn County Jail, Fusak told a Deputy that he would find out where the Deputy lived and that he would physically harm the Deputy's family.

Public record shows that Fusak appeared in Washburn County Circuit Court on July 19, 2017, to be sentenced on his charges of Battery or Threat to Judge, Prosecutor, or Law Enforcement Officer, a Class H Felony and Resisting or Obstructing an Officer, a Class A Misdemeanor. A plea of No Contest to both charges was entered by Fusak on June 15, 2017.

The Court ordered that Fusak serve 3 years on probation (extended supervision by the Wisconsin Department of Corrections [DOC]) for his Felony conviction of Battery or Threat to Judge, Prosecutor, or Law Enforcement Officer, and 9 months of Jail for his conviction of Resisting or Obstructing an Officer, a Class A Misdemeanor. These are to be served consecutively (following) his sentence on his Ashland County Circuit Court conviction for Class C Felony Armed Robbery.

Fusak was sentenced in April 2017 to 3 years of confinement in State Prison for that Ashland County conviction, followed by 2 years of extended supervision.

Additionally, Fusak was sentenced in May 2017 on charges in Sawyer County Circuit Court. The Court ordered a sentence of 3 years of probation for Fusak's conviction for Class I Felony Throw/Discharge Bodily Fluid at Public Safety Worker or Prosecutor and Class I Felony Retail Theft. This probation will also be served consecutively to the Ashland County sentence.

Conditions of Fusak's consecutive probation will include that he pay restitution, complete an Alcohol and Drug Assessment and follow through with any treatment and/or counseling, not possess any alcohol or illegal drugs, and not have any contact with the victims from his various cases.

The Wisconsin DOC website indicates that Fusak was returned to Dodge Correctional Facility on July 19, 2017, by the Washburn County Sheriff's Office.

Alan Fusak, of Prentice, WI appeared in Washburn County Circuit Court on February 13, 2017, on charges of Felony Threat to an officer.

According to public records obtained and reviewed by DrydenWire.com Fusak was arrested by the Washburn County Sheriff's Office on December 10, 2016, after deputies were dispatched to pick up multiple suspects on active warrants due to an investigation into an armed robbery in Ashland County, WI.

Washburn County Sheriff's deputies were en route to the address in Minong Township given them by Washburn County Sheriff's Dispatch when a vehicle was observed at a traffic intersection which deputies identified on sight as belonging to an individual from the address listed in the warrant pick-up call.

Deputies made contact with the vehicle and placed three individuals in temporary custody while the deputies investigated further.

Fusak was located at the address in question and deputies placed him in custody. Fusak was verbally threatening to at least one Washburn County Sheriff's Deputy. Fusak told the Deputy he would find out where the Deputy lived and that he would physically harm the Deputy's family. Fusak yelled obscenities at the Deputy while being transported to the Washburn County Jail. Upon arrival at the Washburn County Jail, Fusak was argumentative and combative, refusing to get out of the squad car on his own, and ultimately passing out on the floor of the jail cell he was moved to.

Charges of Battery or Threat to Judge, Prosecutor, or Law Enforcement Officer, a Class H Felony and Resisting or Obstructing an Officer, a Class A Misdemeanor, were filed against Fusak on January 20, 2017, in Washburn County Circuit Court.

Public record indicates that Fusak remains in the custody of law enforcement and is due to appear again in Washburn County Circuit Court on February 16, 2017.

Fusak has open cases in at least 3 other Wisconsin Counties, including Ashland County where he was charged on December 9, 2016, with Armed Robbery, a Class C Felony, and Burglary While Armed With a Dangerous Weapon, a Class E Felony. On January 7, 2017, Fusak was also charged with Felony Bail Jump. Fusak is due back in Ashland County Circuit Court on February 14, 2017.

In Sawyer County Circuit Court Fusak is charged with Vehicle Operator Flee or Elude Officer, a Class I Felony; Retail Theft, a Class I Felony; and Misdemeanor Resisting or Obstructing an Officer. Fusak is due back in Sawyer County Circuit Court on 3/14/17.

A warrant for Fusak's arrest was issued in Taylor County on January 17, 2017, for charges of Misdemeanor Disorderly Conduct.
