BURNETT COUNTY - An 18-year-old man from Siren, WI, has been sentenced on sexual assault charges stemming from a report that he sexually assaulted a juvenile female in September 2018.
Triston Ortez, of Siren, WI, was age 17 at the time of the reported incident. DrydenWire.com reported in January 2019 that charges had been filed against Ortez following an investigation by the Burnett County Sheriff’s Office into a report that in September 2018 Ortez had sexually assaulted a female under the age of 16.
A criminal complaint filed against Ortez stated that during an interview with law enforcement, Ortez admitted that he had sexual contact with the juvenile female and that he believed her to be age 14 or 15 at the time of the incident.
Ortez was charged with Sexual Assault of Child Under 16 Years of Age (a Class C Felony). Online circuit court records show that at a hearing on April 17, 2019, the Court accepted a plea from Ortez to amended charges of two counts of Misdemeanor 4th Degree Sexual Assault.
The Court heard from the Burnett County District Attorney who recommended 30 days of conditional jail time for Ortez.
Defense counsel for Ortez argued that jail time was not necessary as Ortez confessed to Law Enforcement and Ortez did not have any prior criminal convictions.
The Court ordered 2 years of probation; conditions of which will require Ortez to undergo counseling, a (psycho) sexual evaluation, and an Alcohol and Other Drug Assessment; and maintain Absolute sobriety. Ortez was also ordered to serve 30 days conditional jail. The Court granted Ortez 60 days to report to jail. Ortez will be eligible for an expunction of his conviction upon successful completion of his probation.
