Felony Fleeing Charges Dismissed & Re-Filed After Man Advises Court of Correct ID

A new criminal case has been filed in Burnett County Circuit Court after a man appeared and advised the Court that charges had been filed against the wrong man following a law enforcement pursuit of a vehicle on July 28, 2017.

DrydenWire.com reported on the incident on August 25, 2017, after an arrest warrant was issued for Kyle Rufsholm, the driver of the vehicle, when he failed to appear in Burnett County Circuit Court on his criminal charges of Class I Felony Attempting to Flee a Traffic Officer.

The passenger in the vehicle identified himself as Bobby Brown to officers on scene, however, it was later determined that he was actually Tyrone Larcholey, and criminal charges were filed accordingly.

Online circuit court records show that on August 23, 2017, a man identifying himself once again as Bobby Brown, appeared in Burnett County Circuit Court regarding the charges which had been filed against Tyrone Larcholey for Class I Felony Attempting to Flee a Traffic Officer, Party to a Crime, and Misdemeanor Obstructing for giving a false name to law enforcement.

Brown stated to the Court that he was the passenger in the vehicle on the offense date of July 28, 2017, when the vehicle was spotted by a Burnett County Sheriff's Deputy who attempted to stop the vehicle for erratic driving.

The vehicle did not stop for the Deputy but instead continued on for several miles until it finally stopped at which time a deputy approached the vehicle with a patrol rifle out. A K9 sniff was conducted on the vehicle with positive indications for controlled substances inside the vehicle. During a search of the vehicle law enforcement reportedly located several small clear plastic baggies, a box of heavy-duty garbage bags, rubber gloves, razor blades, and duct tape as well as a battery operated grinder and with multiple disk blades.

Another hearing was held on September 27, 2017, regarding the charges filed against Larcholey, and at that hearing, the case was dismissed upon the request of the Burnett County District Attorney's Office.

On October 2, 2017, a new criminal case was filed against Bobby Brown, charging him with Class I Felony Vehicle Operator Flee/Elude Officer and Misdemeanor Resisting or Obstructing an Officer. Brown is scheduled to appear on his case in November 2017.

As of October 18, 2017, the arrest warrant for Kyle Rufsholm, of Siren, WI, is still active. If anyone knows of his whereabouts, they can contact the Burnett County Sheriff's Department with that information.

Pursuant to the direction of the Wisconsin Supreme Court, as found in Supreme Court Rule 20:3.6, Trial Publicly, you are advised that a charge is merely an accusation and that a defendant is presumed innocent until and unless proven guilty.

An arrest warrant has been issued in Burnett County Circuit Court for a man charged with Fleeing a Law Enforcement Officer.

According to public record, Kyle Rufsholm, of Siren, WI is charged in Burnett County Circuit Court with Class I Felony Attempting to Flee or Elude a Traffic Officer. Rufsholm failed to appear for a scheduled court hearing in Burnett County Circuit Court on August 24, 2017, and the Court has issued a warrant for his arrest.

Charges were filed against Rufsholm after an incident on July 28, 2017, when a Burnett County Sheriff's Deputy spotted a vehicle driving erratically at the Highway 35 roundabout and attempted a traffic stop. Although the Deputy activated his squad car's lights and sirens, the vehicle then traveled away from Highway 35 and continued on for nearly 3 miles, making several turns. According to the criminal complaint, the vehicle was traveling at speeds around 20-30 miles per hour. The vehicle ended up headed back towards Highway 35 on South Shore Drive, at which time, 2 Tribal Police squad cars arrived on the scene and the vehicle finally came to a stop.

The Deputy approached the vehicle with his patrol rifle while telling the 2 people in the vehicle to put their hands out of the windows. Both of the people complied. The driver then turned the vehicle's engine off, as instructed by the Deputy. The criminal complaint states that the driver was told to exit the vehicle with his back to the officer and walk backward until instructed to stop, at which time he then got down on his knees when the Deputy told him to. The driver of the vehicle was then placed under arrest.

The passenger also followed the Deputy's instructions to exit the vehicle with his back facing the officers and walk backward until told to stop. When instructed to do so, the passenger laid down on the ground on his stomach with his hands behind him and was then placed under arrest.

The driver of the vehicle was identified as Kyle Rufsholm. Law enforcement had previously received information that Rufsholm may be transporting methamphetamine into Burnett County from Minneapolis for a drug cartel and that he was possibly scheduled to be transporting about 5 pounds of methamphetamine on the night of this incident.

A K9 sniff was conducted on the vehicle with positive indications for controlled substances inside the vehicle. During a search of the vehicle law enforcement reportedly located several small clear plastic baggies, a box of heavy-duty garbage bags, rubber gloves, razor blades, and duct tape as well as a battery operated grinder and with multiple disk blades.

The passenger of the vehicle initially identified himself as Bobby Brown, with an ID card to confirm that, however follow-up by law enforcement revealed that he was actually Tyrone Larcholey, of Minneapolis, MN.

When asked why he did not stop for the lights and sirens of the squad car, the criminal complaint states that Rufsholm told officers that he had a right to travel to a well-lit area before stopping. The officer pointed out that they had traveled past several well-lit areas. Larcholey allegedly stated to law enforcement that he had told Rufsholm not to stop right away due to all the recent incidents reported in the news about the police.

Rufsholm and Larcholey were both placed under arrest and appeared for bail bond hearings on July 31, 2017. The Court placed them each on a cash bail bond of $250.

Rufsholm is charged with Class I Felony Attempting to Flee a Traffic Officer; Larcholey is charged with Class I Felony Attempting to Flee a Traffic Officer, Party to a Crime, and Misdemeanor Obstructing for giving a false name to law enforcement.

Public record indicates that Rufsholm did not appear as scheduled in Burnett County Circuit Court on August 24, 2017, and the Court issued a warrant for his arrest. No future court date is currently listed for Larcholey regarding his charges.
