Grantsburg Woman Charged with 5th OWI After Allegedly Nearly Causing Head-On Collision

BURNETT COUNTY, Wis. -- A Grantsburg, WI woman has been charged with 5th Offense Operating while Intoxicated (OWI), a Class G Felony, after an incident on May 28, 2017, when she nearly collided with a Wisconsin Department of Natural Resources (DNR) Warden while driving her vehicle on Raspberry Landing Road in Burnett County.

According to the criminal complaint, Guadalupe Colburn has been charged in Burnett County Circuit Court with Felony 5th Offense OWI, Misdemeanor Operating a Motor Vehicle While Revoked (OAR), and Misdemeanor Failure to Install an Ignition Interlock Device.

The criminal complaint states that on May 28, 2017, the Burnett County Sheriff's Department was dispatched to assist a DNR Warden with a possible intoxicated driver after the Warden reported that he was driving on Raspberry Landing Road when he met with a vehicle driving towards him in his lane. The Warden stated that the vehicle nearly collided with him.

The driver of the other vehicle identified herself as Guadalupe Colburn. When Colburn got out of her vehicle she reportedly was having difficulty walking and keeping her balance and the officers could smell intoxicants on her. Officers asked Colburn how much she had to drink that day, and she replied, 'too much.'

Officers confirmed that Colburn had 4 prior convictions for OWI and that because of that she was only allowed a blood alcohol concentration of .02. Colburn performed a preliminary breath test and the result of that test was .215.

Colburn was placed under arrest for OWI at that time. She was transported to the Burnett Medical Center where she consented to a blood draw. The results of that blood draw test are not known to DrydenWire.com at this time.

A review of Colburn's driver's license restrictions indicated that she is also required to have an Ignition Interlock Device (IID) installed in her vehicle and that her driver's license was actually revoked at the time of this incident. Officers confirmed that no IID was installed in Colburn's vehicle.

Public record shows that on May 30, 2017, a bail bond hearing was held for Colburn in Burnett County Circuit Court. The Court set a Signature Bond for Colburn and ordered her to maintain absolute sobriety and to not operate a vehicle without a valid driver's license or without an IID installed in the vehicle. It is also indicated on public record that on June 12, 2017, Colburn posted $250.00 cash bond. Details of that cash bond posting are not known at this time.

Colburn's previous convictions were listed as:

  • on May 14, 1997, in Burnett County, WI in connection with an incident which occurred on April 8, 1997;
  • on October 30, 2001, in Burnett County, WI in connection with an incident which occurred on June 5, 2001;
  • on June 14, 2005, in Burnett County, WI in connection with an incident which occurred on January 8, 2005;
  • and on November 28, 2011, in Burnett County, WI in connection with an incident which occurred on April 1, 2011.

Colburn is scheduled to have an Initial Appearance on June 28, 2017, regarding her charges.
