Jail-Time Ordered For Milltown Man On OWI Conviction

POLK COUNTY -- The Court has sentenced a man for his conviction on charges of Operating While Intoxicated (OWI) which were filed following a crash that occurred in January 2019.

DrydenWire.com previously reported that Robert Bushway was facing charges after the Milltown Police Department responded to a report of a vehicle crashing into a building after striking a sign. The vehicle then got stuck in a snowbank, but after several attempts, he was able to break free and leave the scene.

Subsequent investigation led Officers to Bushway as the registered owner of the vehicle involved in the crash. Bushway and the vehicle were located at Bushway’s residence, and Officers observed significant recent damage to the vehicle.

Bushway told Officers that he did not remember striking anything with his vehicle, however, he did admit to consuming alcohol and then driving himself to his residence.

The charges of 6th Offense OWI which were filed against Bushway were later amended to 4th Offense OWI after his defense counsel filed a Collateral Attack Motion, attacking his prior OWI convictions. Online circuit court records show that in September 2019, the State agreed to stipulate to the Motion and the Court granted the Motion.



At a hearing on January 17, 2020, Bushway was sentenced by the Court on the conviction of 4th OWI. Bushway was ordered to serve 29-days in Polk County Jail with 5 days of credit. He was also ordered to undergo an Alcohol and Other Drug Assessment along with alcohol monitoring/treatment as ordered by the Department of Corrections.
