SAWYER COUNTY -- Sawyer County Circuit Court Judge John Yackel has ordered a 100 year sentence for a man convicted of child sexual assault.
At a sentencing hearing today, January 8, 2019, Judge Yackel sentenced Richard H. Humphrey, of Ojibwa, WI, to a total of 100 years. Humphrey was found guilty of two counts of Class B Felony 1st Degree Child Sex Assault - Sexual Contact with Person under Age of 13 after he plead no contest to the charges on November 13, 2018.
Charges were filed against Humphrey in two separate criminal complaints: the first of which was filed in July 2018 charging Humphrey with two counts of Class B Felony 1st Degree Child Sex Assault - Sexual Contact with Person under Age of 13, one count of Class D Felony Child Enticement-Expose Genitals/Pubic Area/Intimate Parts; and one count of Class I Felony Exposing Genitals/Pubic Area/Intimate Parts to a Child. These charges stemmed from an incident that occurred on July 3, 2018.
The second criminal complaint was filed in August 2018 and charged Humphrey with one count of Repeated Sexual Assault of Same Child (At Least 3 Violations of 1st Degree Sexual Assault) stemming from an incident that occurred on January 1, 2009.
According to the criminal complaint filed against Humphrey in July 2018 the Sawyer County Sheriff’s Office received a report that Humphrey had sexually assaulted a child under the age of 13 in 2009. Through the course of the investigation, it was revealed that there were other children who had also been victimized by Humphrey as recently as July 2018.
The criminal complaint states that Humphrey told investigators that his actions manifested after he turned 50 years old, and that he would also look at images of child pornography.
Humphrey was placed on a $100,000 cash bail bond by the Court at a hearing on July 20, 2018.
On November 13, 2018, Humphrey plead No Contest to two charges of Class B Felony 1st Degree Child Sex Assault - Sexual Contact with Person under Age of 13 ( one of those was reduced from Repeated Sexual Assault of Same Child (At Least 3 Violations of 1st Degree Sexual Assault). The remaining charges against Humphrey were dismissed as part of a plea agreement, but read in for consideration at sentencing.
At Humphrey’s sentencing hearing today, according to online circuit court records, the State and Humphrey’s defense counsel made a joint recommendation for a 25 year sentence - 12 initial confinement in state prison followed by 13 years of extended supervision.
Judge Yackel ordered 50 years on each of Humphrey’s convictions; 30 years initial confinement in state prison, followed by 20 years extended supervision. Humphrey will serve his sentences consecutively, resulting in a total of 100 years.
