Man Charged With Sexually Assaulting Woman He Met On Dating App

WASHBURN COUNTY — A 24-year-old Hayward, WI man is facing felony charges of sexual assault in Washburn County Circuit Court following an investigation by the Washburn County Sheriff’s Office.

On July 22, 2019 Washburn County Sheriff’s Dispatch received a call from an 18-year-old female who was stating that she needed to report a sexual assault.

Deputies picked up the female and brought her back to the Washburn County Sheriff’s Office to speak about the alleged assault.

The female identified Brandon Miller, age 24 of Hayward, WI as the individual who allegedly assaulted her.

The criminal complaint filed against Miller states that in the afternoon of July 21, 2019, Miller communicated with the female via a social media messaging app and that arrangements were made for Miller to pick up the female so that they could spend time together. Investigators viewed messages exchanged between the female and Miller.

In a statement provided to law enforcement the female stated that she met MIller through an online dating website. She went on to say that when Miller arrived to give her a ride to Hayward, she told Miller that she had a boyfriend and that she did not wish to engage in any sexual activity with Miller.

Miller took the female to his residence after purchasing food at McDonalds in Hayward, WI, and according to the criminal complaint, upon arriving at the residence, Miller offered the female a beverage.

After consuming the beverage, the female stated that she felt “woozy, loopy, out of it”. Due to feeling this way, the female asked if she could lay down, and Miller allegedly told her that was fine.

In her statement the female went on to say that she awoke a few hours later, and found herself to be naked, with Miller engaged in sexual intercourse with her. Following this, the female told Miller to take her to her sister’s residence, and he did, according to the criminal complaint.

Later that evening, the female decided to contact law enforcement regarding the alleged assault. Following her interview with law enforcement, the female was taken to a medical facility for an exam and medical care.

Investigators with the Washburn County Sheriff’s Office obtained a search warrant for Miller’s residence, and while executing that search warrant, numerous items of drug paraphernalia were located including 2 scales, multiple vape cartridges, multiple glass smoking pipes, and 2 bongs as well as over 40 grams of marijuana, and 2 grams of marijuana wax.

Blankets, sheets, pillowcases, clothing items, and tissue from a trash can were also collected during the search warrant.

All items of evidence are to be submitted to the Wisconsin State Crime Lab for testing, according to the criminal complaint.

When Investigators spoke with Miller, he stated that he had been advised by the Wisconsin State Public Defender’s Office not to appear for an interview with the Sheriff’s Office Investigator.

Miller is charged with Class C Felony Second Degree Sexual Assault / Unconscious Victim, Class G Felony Third Degree Sexual Assault, Class I Felony Possession With Intent To Deliver THC (Marijuana) <=200 Grams, and Misdemeanor Possession of Drug Paraphernalia.

At a bail hearing on July 25, 2019, Miller was placed on a $500 signature bail bond with conditions prohibiting him from consuming any alcohol or controlled substances. Miller is scheduled to appear in August 2019 regarding his criminal charges.

Pursuant to the direction of the Wisconsin Supreme Court, as found in Supreme Court Rule 20:3.6, Trial Publicly, you are advised that a charge is merely an accusation and that a defendant is presumed innocent until and unless proven guilty.
