Turtle Lake Man Gets 10 Months in Jail After 5th OWI

POLK COUNTY -- Turtle Lake, WI man, Donald Duclon, has plead guilty to his charge of Operating While Intoxicated (OWI) 5th Offense, and the Court has ordered 10 months of conditional jail time, with 5 years of probation.

Duclon appeared in Polk County Circuit Court on September 18, 2017, according to online circuit court records, and entered a plea of Guilty to his charge of OWI 5th Offense. The other charges against him, Misdemeanor Operating While Revoked, and 3 counts of Misdemeanor Bail Jumping were dismissed.

Charges were filed against Duclon following a traffic stop by the Polk County Sheriff's Office on August 3, 2017. At the time of the traffic stop, Duclon was under conditions of the bail bond in Barron County Circuit Court which prohibited him from possessing or consuming alcohol, according to a Polk County Sheriff's Office probable cause report. Duclon also had a restriction on his driver's license prohibiting him from having a blood alcohol concentration over .02. When Duclon submitted to a preliminary breath test, the result was .10.

The Court ordered Duclon to serve 10 months of conditional jail time, with eligibility for Huber work privileges and credit for 46 days previously served. Duclon must also undergo an alcohol and drug assessment, maintain absolute sobriety, and his driver's license is to be revoked for 24 months. He was also ordered to pay fines and costs in the amount of $1,744. Duclon will be under the supervision of the Wisconsin Department of Corrections, Probation, and Parole for a period of 5 years.

POLK COUNTY -- The Court has reduced the bail bond for a man charged in Polk County with Operating While Intoxicated (OWI) 5th Offense.

According to public record, a preliminary examination hearing was held on August 10, 2017, for Duclon on his Felony OWI charges. After the Court found probable cause to move forward with Donald Duclon's felony charges, Duclon's dense attorney introduced a motion to reduce the $1,000 cash bail bond which the Court had placed Duclon on.

Although the State opposed the motion, the Court did reduce Duclon's cash bail bond to $750. As of the time of this post, Duclon remains in the custody of the Polk County Jail.

Duclon was charged with OWI 5th Offense following a traffic stop by the Polk County Sheriff's Office on August 3, 2017, According to the Polk County Sheriff's Office probable cause report, a preliminary breath test indicated that Duclon's breath alcohol level was .10. Duclon has a restriction on his driver's license that prohibits him from having an alcohol level of more than .02.

POLK COUNTY -- A Turtle Lake man is facing Felony charges for Operating While Intoxicated 5th Offense following a traffic stop in Milltown, in Polk County.

According to the probable cause report from the Polk County Sheriff's Office, the Deputy stopped the vehicle after a check of the vehicle's registration indicated that the registered owner had a revoked driver's license.

The driver of the vehicle was identified as Donald Duclon, of Turtle Lake, WI. The probable cause report states that the Deputy asked Duclon if he had been drinking that day, to which Duclon replied no. The Deputy also reportedly asked Duclon if he had any open cases, to which Duclon also replied no.

Duclon is actually currently under conditions of a bail bond in Barron County Circuit Court which prohibits him from possessing or consuming alcohol, the probable cause report goes on to state. Duclon also has a restriction on his driver's license prohibiting him from having a blood-alcohol concentration over .02. When Duclon submitted to a preliminary breath test, the result was .10. The Deputy also discovered that Duclon had previously been convicted of OWI on 4 separate occasions. Duclon agreed to an evidentiary blood draw and was taken to a hospital for that.

Public record indicates that criminal charges were filed in Polk County Circuit Court on August 4, 2017, charging Duclon with Class G Felony OWI 5th Offense, Misdemeanor Operating While Revoked, and 3 counts of Misdemeanor Bail Jumping. According to public record, Duclon appeared in Polk County Circuit Court on August 4, 2017, and the Court placed him on a $1,000 Cash Bail Bond. He is due back in Court on August 10, 2017.

Duclon also has 3 other open court cases in Barron County charging him with a total of 4 counts of misdemeanor bail jump, misdemeanor resisting or obstructing an officer, and misdemeanor operating while revoked. The details of those cases are not known to DrydenWire.com at this time.
