New Charges Filed Against Spooner Man Charged with 7th OWI

SHELL LAKE, Wis. -- New charges have been filed in Washburn County Circuit Court against Brien Drain, a Spooner, WI man charged with 7^th Offense OWI.

DrydenWire.com initially reported on this story on April 15, 2017 when press releases were issued by both the Wisconsin State Patrol and the Washburn County Sheriff's Office after an incident in which Drain led law enforcement on a chase that was only brought to a close when officers executed a PIT maneuver utilizing squad cars to impact Drain's vehicle, causing a stop. During that chase Drain was travelling at speeds up to 85 miles per hour in a 55 mile per hour zone. Damage was sustained by a Wisconsin State Patrol Cruiser and a Washburn County Sheriff's Office squad car as result of this incident. Drain refused to comply with officers after his vehicle was brought to a stop, and officers had to extricate him from his vehicle.

Drain failed to appear for a Washburn County Circuit Court hearing on his felony charges of Felony Operator Flee/Elude Officer – Bodily Harm or Property Damage; Felony 7^th Offense OWI; Felony Bail Jumping stemming from that April 14 incident, and the Court issued a warrant for his arrest. DrydenWire.com reported that on May 11, 2017, Drain appeared and the Court increased his bail bond to $1,000 cash.

According to public record on May 26, 2017, two additional court cases have now been filed against Drain in Washburn County Circuit Court; charging him with a total of three counts of Felony Bail Jump. The details of those cases are unknown at this time.

Public record also shows that Drain appeared on May 30, 2017 while in the custody of the Washburn County Sheriff's Office for a preliminary examination hearing in Washburn County Circuit Court regarding his felony charges for Felony Operator Flee/Elude Officer – Bodily Harm or Property Damage; Felony 7^th Offense OWI; Felony Bail Jumping stemming from that original April 14 incident.

The Court heard testimony from a Wisconsin State Patrol Trooper on those felony charges and after finding probable cause bound Drain over for trial.

Drain is scheduled to appear again on June 5, 2017.

Spooner Man Appears in Court on Arrest Warrant Stemming from 7th OWI

SHELL LAKE, Wis. -- According to public record, Brien Drain of Spooner, WI appeared in Washburn County Circuit Court today May 11, 2017 on his arrest warrant which was issued on April 24, 2017.

DrydenWire.com reported that Brien Drain was released by the Court on a $500 cash bond on April 17, 2017 following Drain's arrest on April 14, 2017 for 7^th Offense Operating While Intoxicated (OWI).

Drain failed to appear for his next scheduled court appearance on April 24, 2017, and the court issued a warrant for Drain's arrest.

Public record shows that at a bail hearing today, May 11, 2017, the Court set a $1,000 cash bond for Drain with conditions that he is not to consume any alcohol or possess or consume any controlled substances without a prescription. Drain was also given a curfew of 8 pm – 6 am daily.

Arrest Warrant Issued for Spooner Man Charged with 7th OWI

SHELL LAKE, Wis. -- Brien Drain, of Spooner, WI, was scheduled to be in Washburn County Circuit Court yesterday, April 24, 2017, after being released on $500 cash bond last week (full story below). Drain is charged with Felony Operator Flee/Elude Officer – Bodily Harm or Property Damage; Felony 7^th Offense OWI; Felony Bail Jumping.

According to public record, Drain was not in court today, and a warrant for his arrest has been issued.

Public record also shows that a warrant was issued in Douglas County Circuit Court on April 21, 2017, for Drain. He is charged with Felony Possession of Methamphetamine and Felony Bail Jump in Douglas County.

Drain has an additional case open in Barron County Circuit Court with charges of Felony Bail Jump, Felony Possession of Methamphetamine, Misdemeanor Possession of Marijuana, Misdemeanor Possession of Drug Paraphernalia, and Misdemeanor Resisting/Failing to Stop. A Jury Trial is scheduled for May 16 in Barron County on those charges.

Judge Releases Spooner Man Charged with 7th OWI on $500 Bond

SHELL LAKE, Wis. -- Washburn County Circuit Court Judge Eugene Harrington has released Spooner, WI man Brien Drain on a $500 cash bond on April 17, 2017 following Drain's arrest on April 14, 2017 for Felony 7^th Offense Operating While Intoxicated, and Knowingly Fleeing an Officer in which Drain refused to stop for a Wisconsin State Trooper who attempted to stop Drain while he was travelling at speeds up to 85 miles per hour in a 55 mile per hour zone.

DrydenWire.com 1st reported on the story on Saturday morning, April 15th, 2017, via a press release from the Wisconsin State Patrol. Later that day, Washburn County Sheriff Terry Dryden issued a release with a booking photo and more information.

According to both releases, after the use of stop sticks/tire deflation devices, Drain's vehicle was ultimately brought to a stop by a PIT maneuver executed by a Wisconsin State Trooper. The PIT maneuver involves utilizing a squad car to impact the suspect's vehicle causing a stop. A Wisconsin State Cruiser and a Washburn County Squad car both sustained damage from this incident.

After the vehicle was stopped, officers had to extricate Drain from his vehicle after he refused to comply with officer's orders. No injuries were incurred by any officers or by Drain as a result of the incident.

Public record shows that charges have been filed against Brien Drain in Washburn County Circuit Court today April 21, 2017, for Class H Felony Operator Flee/Elude Officer – Bodily Harm or Property Damage, Class F Felony OWI 7th Offense, and Class H Felony Bail Jumping.

Drain is scheduled to appear on Monday, April 24, 2017, on these charges.
