Polk County Man Sentenced on Child Sex Crime Case

An Amery, WI man has been sentenced in Polk County Circuit Court regarding child sex crime charges filed against him in December 2017.

Online circuit court records show that Shawn Binkley, of Amery, WI was recently sentenced on a conviction of Class I Felony Expose Child to Harmful Descriptions.

The criminal complaint filed against Binkley stated that he had sent sexually inappropriate text messages to a 12 year old female in early December 2017.

Binkley was originally charged with Class C Felony Use of a Computer to Facilitate a Child Sex Crime, Class D Felony Child Enticement - Sexual Contact, and Class D Felony Child Enticement - Expose Genitals.

At a plea hearing held in April 2018, the Court accepted a No Contest Plea from Binkley on a reduced charge of Class I Felony Expose Child to Harmful Descriptions (amended from Class C Felony Use of a Computer to Facilitate a Child Sex Crime). The other charges filed against Binkley were dismissed but read in.

The Court ordered a withheld sentence for Binkley; 2 years of probation and 1 year of conditional jail time - stayed and banked to be used by the Department of Corrections, Probation and Parole, if necessary. Binkley received credit for 47 days previously served in jail.

Conditions of Binkley’s probation require him to complete a Psychosexual assessment and comply with recommendations. Binkley will be required to register on the Sex Offender Registry for 15 years. He is also prohibited from having any unsupervised contact with any females under the age of 17. In addition, Binkley must complete an Alcohol and Other Drug Assessment and comply with recommendations of that assessment.

Child Enticement Charges Filed Against Amery Man

Charges of Child Enticement have been filed against an Amery, WI man after the Amery Police Department investigated a complaint of inappropriate text messages being received by a 12 year old female victim.

A probable cause report from the Polk County Sheriff’s Office states that the Amery Police Department received a call from the Amery Middle School on December 7, 2017, stating that a 12 year old female student had reported receiving inappropriate text messages from an adult male that she knows.

The 12 year old victim allowed the messages to be photographed and copies were provided to law enforcement. The phone number which the messages originated from was identified as belonging to Shawn Binkley.

The messages started shortly after 5 pm on December 3, 2017 and some of the messages contained the following text:

  • "I really think your sexy"
  • "Im ready too"
  • "Start stripping"
  • "Hey beautiful turn that down"
  • "Just get up so I can see your hot ass"
  • "You still up beautiful"

In the early morning hours of the next day, December 4, 2017, the victim received another text message which read:

"Let’s just forget about last night"

The victim also provided a written statement in which she said that the day after receiving the text messages, Binkley told her not to tell anyone about them and that if she did, he would hurt her.

Binkley was placed under arrest on December 7, 2017, and online circuit court records show that he appeared for a bail bond hearing on December 8 at which time he was placed on a $10,000 cash bond. It is believed that at the time of this post, Binkley remains in the custody of the Polk County Jail.

Binkley is charged with Class C Felony Use of a Computer to Facilitate a Child Sex Crime, Class D Felony Child Enticement - Sexual Contact, and Class D Felony Child Enticement - Expose Genitals.

Pursuant to the direction of the Wisconsin Supreme Court, as found in Supreme Court Rule 20:3.6, Trial Publicly, you are advised that a charge is merely an accusation and that a defendant is presumed innocent until and unless proven guilty.
