Probation Ordered in Domestic Abuse Strangulation Case

Larry Suess, of Siren, WI, was ordered to serve 1 year on probation for a conviction of Misdemeanor Battery in a case which was set for jury trial in Burnett County Circuit Court.

DrydenWire.com reported on July 14, 2017, that Suess was scheduled to take his case to a jury trial on July 18, 2017. Suess faced charges of Class H Felony Strangulation and Suffocation, Class A Misdemeanor Domestic Battery, and Class B Misdemeanor Domestic Disorderly Conduct stemming from a December 2015 incident in which he violently assaulted his live-in girlfriend. 

The criminal complaint filed against Suess stated that he attacked his victim multiple times, punching her, choking her, slamming her head into a shower wall, and locking doors so that she could not initially get out of the residence. (see story below)

Public record shows that on July 18, 2017, Suess entered a plea of No Contest to the charge of Class A Misdemeanor Domestic Battery. The Court ordered an Imposed and Stayed sentence of 90 days in jail with 1 year of probation under the supervision of the Wisconsin Department of Corrections (DOC) Imposed. 

With an Imposed and Stayed jail sentence, Suess will not serve that jail time unless the Court and/or the DOC determines that his probation should be revoked because he violates the conditions of his probation in some way.

The other charges filed against Suess were dismissed but read-in by the Court. Under the conditions of his probation, Suess was ordered to have no contact with the victim in his case and to complete an Alcohol and Drug Assessment and comply with any treatment recommended.

A Jury Trial is scheduled on charges of Felony Strangulation and Suffocation in Burnett County Circuit Court regarding an incident which occurred in December 2015.

Burnett County Dispatch received a call for assistance on December 4, 2015, from a female victim who stated that her live-in boyfriend, Larry Suess, of Siren, WI, had violently assaulted her.

According to the criminal complaint, the victim stated to law enforcement that Suess arrived home intoxicated and began threatening her with his fists and verbally assaulting her and accusing her of cheating on him.

The victim stated that she went into the bedroom to get away from Suess, but that he kicked the door in and then reportedly began punching her with a closed fist. The criminal complaint goes on to state that Suess allegedly put both of his hands around the victim's throat and applied pressure, blocking her ability to breathe for several seconds.

The victim went on to tell law enforcement that she hit and kicked Suess to get away from him and was able to get into the bathroom and close that door and lock it, however, Suess then kicked that door in and continued the attack.

According to the victim's statement, Suess threw the victim onto the bathroom floor and choked her again. She went on to state that when she tried to get away, Suess pushed her into the shower and then slammed the back of her head into the tiled shower wall.

The criminal complaint goes on to state that the victim reported that she was able to get out of the bathroom, but that Suess continued to follow her throughout the house, throwing her down and choking her. At one point Suess reportedly locked the front door and stood in front of it, telling her “you ain't [expletive] leaving.”

When the victim got out of the house by a different door, she went into the garage to attempt to get into her vehicle and leave, but Suess came into the garage and closed the overhead door and again allegedly told her “you ain't [expletive] leaving, you better call your brother.”

The victim went back into the house with Suess, and when he went into another room she ran from the residence, dressed only in a t-shirt, shorts, and socks, not even having time to grab any shoes, and ran to her brother's house, where she called 911.

According to the victim's statement, Suess had previously threatened her on more than one occasion, once with a knife, once with a chair, and once by putting a gun to her head.

Charges of Class H Felony Strangulation and Suffocation, Class A Misdemeanor Domestic Battery, and Class B Misdemeanor Domestic Disorderly Conduct were filed against Suess in Burnett County Circuit Court on December 14, 2015, following the incident. Public record shows that Suess appeared on December 9, 2015, for a bail bond hearing, and was placed on a $2,000 signature bond.

A jury trial is scheduled for July 18, 2017, in Burnett County Circuit Court on Suess's charges. (Prior jury trial dates were scheduled for October 2016 and February 2017. It is not known at this time why those trial dates were not held.)

Pursuant to the direction of the Wisconsin Supreme Court, as found in Supreme Court Rule 20:3.6, Trial Publicly, you are advised that a charge is merely an accusation and that a defendant is presumed innocent until and unless proven guilty.
