A 19-year-old Shell Lake, WI man faces charges of 2nd-degree sexual assault of a child under the age of 16.
According to the criminal complaint, Washburn County Sheriff's Office investigators received a complaint that in July of 2016, Tyler Milton of Shell Lake, WI had sexual contact with a female victim born in 2002.
Interviews with the victim revealed that Milton visited the victim on at least two occasions at the Trego Park where she was residing with her mother. The victim stated to investigators that Milton rode his bike to meet her. Milton reportedly had conversations with the victim about their future together, talking about having children and buying a home. The victim's mother left the camper where the victim was living with her mother and then Milton proceeded to have sexual intercourse with the victim.
The first and second incident were within a week of each other according to the victim's statements to investigators. The criminal complaint continues stating that after the second incident, the mother of the victim became aware of what had happened due to hearing statements made by the victim to a friend of hers. The mother took the victim to see a doctor and advised Milton that he was no longer welcome at their residence. The mother of the victim also told investigators that Milton later came to another residence where she and the victim were visiting. She stated that they had Milton removed from the property.
Milton has been charged in Washburn County Circuit Court with two counts of Class C Felony2nd Degree Sexual Assault of a Child. If convicted of these charges, Milton could face a total of 40 years confinement in State Prison on each count.
Public record shows that Milton also has other pending criminal charges in Washburn County Circuit Court. In one case filed on September 14, 2016, Milton is charged with Class H Felony Battery or Threat to a Judge, Prosecutor or Law Enforcement Officer, and Class B Misdemeanor Disorderly Conduct. In yet another open Washburn County Case filed on September 16, 2016, Milton is charged with Class H Felony Bail Jumping and Class B Misdemeanor Disorderly Conduct.
Milton also has charges in a separate Washburn County Circuit Court Case filed on November 8, 2016 for Battery or Threat to a Judge, Prosecutor or Law Enforcement Officer, a Class H Felony; Throw/Discharge Bodily Fluids at Public Safety Worker or Prosecutor, a Class I Felony; Interfere with Fire Fighting – Alarm/Fighters, a Class I Felony; Criminal Damage to Property, a Class A Misdemeanor; and Disorderly Conduct, a Class B Misdemeanor. In another case filed on November 8, 2016, in Washburn County Circuit Court against Milton, he is charged with Class A Misdemeanor Theft of Movable Property.
Milton is due in Washburn County Circuit Court again on May 3, 2017.
According to public record, Milton was previously convicted in Lincoln County Wisconsin Circuit Court on August 23, 2016, for Class H Felony Battery by Prisoners in one case and in a separate Lincoln County case he was convicted on the same date for Class I Felony Prisoner Throw/Expel Bodily Substances. Milton was also convicted in a Dane County Circuit Court case in January 2017 for Class I Felony Prisoner Throw/Expel Bodily Substances.
Milton originally received probation for his Lincoln and Dane County convictions, however, public record shows that on March 21, 2017, his probation was revoked on his Lincoln County convictions and he was sentenced to 1 year in state prison followed by 2 years of extended supervision.
