Siren Man Charged with Felony Fleeing and Felony 5th Offense OWI

Felony charges of Felony 5th Offense Operating While Intoxicated and Felony Attempting to Flee or Elude an Officer are filed in Burnett County Circuit Court against a Siren Man.

In December 2015 a Burnett County Sheriff's Department deputy saw a vehicle travelling at excessive speeds on State Road 70 and the deputy activated the squad car's emergency lights and siren and engaged in a pursuit of the vehicle. The deputy registered that the vehicle reached speeds of 105 miles per hour (mph) at times before the driver finally slowed and pulled over near the intersection of State Road 70 and Trails End Road.

According to the criminal complaint, the driver of the vehicle immediately exited the vehicle as it came to a stop. The male driver began approaching the squad car and continued coming towards the deputy even after repeated commands by the deputy to face away and put his hands in the air. The deputy unholstered his firearm and repeatedly gave directions to the driver to keep his hands in the air and to face away from the deputy, and the driver did finally comply, stating 'I'm f***ked, you got me.”

After the driver cooperated by dropping to his knees the deputy re-holstered his firearm and approached the driver and took him into custody.

The criminal complaint continues stating that the driver told the deputy that no one else was in the vehicle and that he “had it to the floorboards”. The driver also told the deputy that he was racing to see his father who had just had a heart attack. Then the driver told the deputy that he had just left a party and was on his way to see a friend.

The driver of the vehicle was identified as Robert Mishler of Siren, WI.

During a standard safety check of Mishler for weapons, the deputy found a burning cigarette in Mishler's shirt pocket. Mishler told the deputy he thought he had spit out the cigarette. The deputy also found a folding knife inside Mishler's pants pocket.

The criminal complaint states that Mishler was driving a white Plymouth Voyager van at the time of this incident. The deputy took Mishler to Burnett Medical Center for an evidentiary blood draw.

During the transport to the hospital, Mishler told the deputy that if he would let Mishler go, then Mishler could go buy drugs. The deputy advised Mishler that he would not be doing that.

Charges of Felony Vehicle Operator Fleeing an Officer and Felony Operating While Intoxicated 5th Offense were filed against Mishler on January 11, 2016. An additional count of Felony 5th Offense Operating With a Prohibited Blood Alcohol Concentration was filed on February 12, 2016 stating that Mishler's blood alcohol level was 0.188 when tested.

According to public record, Mishler appeared in Burnett County Circuit Court on April 6, 2017, and a Jury Trial is now set for September 26, 2017 regarding these charges.

Public record shows that Mishler has previous convictions for Possession of Marijuana, Possession of Drug Paraphernalia, Transporting a Loaded Firearm in a Vehicle, and OWI 4th Offense in Burnett County Circuit Court.
