St. Croix Falls Man Who Took 'Upskirt' Photo Of Woman At Walmart Store Sentenced

POLK COUNTY The Court has ordered jail time for a man who was charged with taking an “upskirt” photo of a woman at a St. Croix Falls Walmart.

DrydenWire.com reported in July 2019 that Tyler Nelson was facing felony charges after he was caught on Walmart CCTV and reported to the Polk County Sheriff’s Office.

Walmart Asset Protection provided the CCTV footage which allegedly showed Nelson following a blonde female at the Walmart store. While the female was in the greeting card area of the store, the video footage allegedly showed Nelson crouching down behind the woman and using his cell phone to take a picture. A Walmart employee saw what happened and told the woman, after which the employee and the woman left the area and immediately told Asset Protection what had happened.

When Law Enforcement made contact with Nelson he admitted to taking the photo and also admitted that it wasn’t the first time, telling Law Enforcement that he had taken “upskirt” photos of numerous women in the past, primarily at Walmart, according to the criminal complaint.



Nelson was charged with Class I Felony Invade Privacy. Online circuit court records show that a second charge of Misdemeanor Invade Privacy was later added.

At a recent hearing, Nelson entered a plea of guilty to both charges. The Court accepted the pleas, and also accepted a 3-year Deferred Sentence Agreement regarding the felony charge. For the Misdemeanor charge, the Court ordered a withheld sentence; 1 year of probation; and 21 days County Jail.

The Court also ordered Nelson to undergo a Psycho Sexual Evaluation and comply with any treatment or programming required by the Department of Corrections.

Nelson is prohibited from having any contact with the Saint Croix Walmart or the victim of the case.
