Woman Charged With Sexual Assault Gets Probation

BURNETT COUNTY, Wis. -- A woman charged with Sexual Assault was sentenced to 1 year of probation in Burnett County Circuit Court yesterday, May 10, 2017.

Donna Saenger was charged with Class C Felony 2nd Degree Sexual Assault of a person suffering from a mental deficiency which renders that person incapable of appraising another's conduct.

According to public record, at a hearing yesterday, May 10, 2017, the State made a motion to amend the charge to 4th Degree Sexual Assault, which is a Class A Misdemeanor. Saenger entered a plea of No Contest to that amended charge. Public record also shows that the State moved to amend Saenger's charge of Felony Perjury Before a Court in her second pending criminal case to a county ordinance and that the Court accepted a plea of No Contest from Saenger on that amended charge as well.

Saenger was sentenced to 1 year of probation for her conviction of 4th Degree Sexual Assault, which would be under the supervision of the Wisconsin Department of Corrections. According to public record, Judge Kenneth Kutz also ordered Saenger to pay a fine of $183.00 on her second conviction.

SIREN, Wis. -- Charges of 2nd Degree Sexual Assault of a person suffering from a mental deficiency which renders that person incapable of appraising another's conduct are filed in Burnett County Circuit Court against Donna Saenger, formerly of Frederic, most recently of Grantsburg, WI.

The Siren Police Department responded to a complaint of an alleged sexual assault on the evening of May 24, 2013. The criminal complaint states that the victim was a developmentally disabled adult male. The victim stated to the investigating officer that Saenger and her husband at the time went to his residence. Saenger's husband reportedly announced himself as a police officer, and the alleged victim opened his door.

The alleged victim stated to the investigating officer that both Saenger and her husband came into his residence. The alleged victim stated that Saenger tried to sit on his lap and that he pushed her away and said no, however, Saenger would not stop. The criminal complaint states that Saenger pulled down the alleged victim's pants and touched his privates. The alleged victim stated that he continued to tell her no and push her away but she continued to force herself on him. Ultimately, the alleged victim stated that Saenger had sexual intercourse with him in his bedroom against his free will and consent.

According to the criminal complaint, in an interview with police, Saenger stated that the victim “doesn't even know what's going on.”

Saenger is charged with Class C Felony 2nd Degree Sexual Assault of a person suffering from a mental deficiency which renders that person incapable of appraising another's conduct. If convicted of this charge, Saenger could face a sentence of confinement in state prison for not more than 40 years, or a fine of not more than $100,000, or both.

In a separate case in Burnett County Circuit Court, Saenger is also charged with Felony Perjury Before a Court.

Public record shows that Saenger entered into a Deferred agreement (deferred sentence) on January 5, 2015, on the sexual assault charge, and is now scheduled for a plea hearing on this case on May 10, 2017.
