Woman Sentenced On Conviction From Polk County Drug Bust

POLK COUNTY -- The Court has sentenced the first of two women who were charged criminally following a drug bust that occurred in February 2020 in Polk County.

DrydenWire reported on February 17, 2020, that law enforcement had executed a search warrant at an Osceola, WI residence and located two adult women and several juveniles, according to a probable cause report from the Polk County Sheriff’s Department. Authorities also found a purse, within the reach of the children in the residence, which contained over 130 grams of methamphetamine, marijuana, a digital scale, and a credit card with Tibbett’s name on it. In the basement of the residence, authorities found a digital scale with suspected methamphetamine residue inside a laundry basket of clothing in a child’s bedroom. In the attached garage authorities found another bag that contained a small amount of methamphetamine, more items of drug paraphernalia including another digital scale with residue on it, and a bong with suspected methamphetamine residue in the bottom.

The two women were identified as Marlaina Tibbetts and Sara Schaar Dubois. Tibbetts was charged with two counts of Class C Felony Possess w/Intent - Amphetamine (>50g), Class D Felony Possess w/ Intent-Amphetamine(>10-50g), Class I Felony Maintain Drug Trafficking Place, Class I Felony Neglecting a Child (Harm Did Not Occur and Child Under 6 Years or Disability), two counts of Misdemeanor Neglecting a Child (Specified Harm Did Not Occur), Misdemeanor Possess THC (Marijuana) Party to a Crime, and Misdemeanor Possess Drug Paraphernalia, Party to a Crime. All charges filed against Tibbetts have a penalty enhancer attached for a Repeat Offender.

Tibbetts appeared by video from an Adult Teen Challenge Program for a hearing on May 26, 2021. The Court heard from the District Attorney and defense counsel for Tibbetts regarding the proposed resolution of the case. The Court accepted Tibbetts’ plea of guilty to an amended charge of Class I Felony Possession of Methamphetamine. Online circuit court records show that the remaining charges filed against Tibbetts were dismissed but read in.

The Court ordered a withheld sentence for Tibbetts with 3 years of probation. Conditions of probation will require Tibbetts to successfully complete the Adult Teen Challenge program. She is also required to undergo an Alcohol and Other Drug Assessment, comply with recommendations and complete any treatment or programming required by the Department Of Corrections. Upon release from treatment, Tibbetts will be required to maintain full-time employment.

Schaar Dubois is charged with Class I Felony Maintain Drug Trafficking Place, Class I Felony Possession of Methamphetamine, two counts of Class I Felony Neglecting a Child (Harm Did Not Occur and Child Under 6 Years or Disability), Misdemeanor Neglecting a Child, and Misdemeanor Possess Drug Paraphernalia.

Online circuit court records show that a jury trial is scheduled in August 2021 for Schaar Dubois.
